The Happy Baby Class – Terms of Use

The information provided by midwives as part of The Happy Baby Classes service is for general educational informational purposes and does not constitute the practice/advice of medicine, nursing, midwifery or other professional healthcare services, including the giving of medical advice. Please note no doctor-patient relationship is formed.

The use of information from this website, our social media, our classes or class notes is at the user’s own risk. The content of this website, our social media, our classes or class notes is not intended to be a substitute for professional medical advice, diagnosis or treatment. Users should not disregard or delay in seeking medical advice for any medical condition they or their baby might have and should seek the assistance of their healthcare professionals for any such conditions.

Each of The Happy Baby Class classes is delivered by independent consultants

1. Acceptance of Terms

The Terms and Conditions of Use Agreement (hereinafter referred to as the “Agreement”) set forth legally binding terms for your use of the Website. By using our Website, you agree to be bound by this Agreement, whether you are a “Visitor” (which means that you simply browse one or more of our Websites) or you are a “Member” (which means that you have registered on one of our Websites as a user of a class). If you do not accept the terms of this Agreement, you should leave our Website and discontinue use of the Service immediately. We may modify this Agreement from time to time, and such modification shall be effective upon its posting on any of our Websites. You agree to be bound by any modification to this Agreement when you use any of our Websites after any such modification is posted; it is, therefore, important that you review this Agreement regularly.

2. User Disputes

You are solely responsible for your interactions with Midwives and other users of our classes. The Happy Baby Class reserves the right but has no obligation, to monitor or litigate disputes between you and other Members.

3. Term and Termination

This Agreement shall remain in full force and effect for so long as it is posted on any of our Websites. The Happy Baby Class reserves the right to terminate your account or your access to our services immediately, with or without notice to you, and without liability to you, if The Happy Baby Class believes that you have breached any of the terms of this Agreement, furnished The Happy Baby Class with false or misleading information, or interfered with the use of the Website or the Service by others.

4. Payments, Cancellations, Refunds.

Persons who purchase any of the classes outlined on this website will be charged a one-time payment that is listed on the individual class product page. Once payment is received, you will receive a confirmation email to the email you provided on sign up/payment.

The Happy Baby Class reserves the right to cancel any Live in Person course however to date The Happy Baby Class has cancelled very few courses. If The Happy Baby Class cancels a course due to low attendance The Happy Baby Class will provide the attendee with a certificate to participate in a future class.

Our support team will acknowledge receipt of your cancellation within 14 days.

If you cancel more than 10 weeks before any of our classes you will receive a 50% refund of the class cost. If you cancel between 10 weeks and 8 weeks before any of our classes then you will receive a 25% refund of the class cost. If any cancellation request is received within 8 weeks of a class then you will not receive any refund.

5. Rescheduling

The Happy Baby Class reserves the right to reschedule a class at any time. In the situation where a class is rescheduled, you will not receive a refund. You will receive an email notifying you of the next available classes and will be allowed to choose one which is suitable.

6. Technical Issues

Due to the online nature of the live classes, The Happy Baby Class and its customers may encounter technical issues at any stage of the class.

In the event that a technical issue occurs as a fault of The Happy Baby Class resulting in none of the paid customers of a class having the ability to join, a new class will be set up and an invite will be sent out immediately. In the event that The Happy Baby Class continues to encounter difficulties, the attendees of the class will be given the option to attend any of the future classes.

Customers are required to check that their internet connection has a high enough download speed in order to view our classes without encountering technical issues. Please ensure that this is done by using an online speed test. The Happy Baby recommends having an internet connection with a download speed of 2-5 Mbps. Once you purchase a class from us you will automatically receive a registration email where you can also check the speed of your connection.

YOU AGREE THAT YOUR USE OF THE WEBSITE SHALL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, The Happy Baby Class, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE WEBSITE AND YOUR USE THEREOF. Limitation on Liability

Exclusions and Limitations

Those who access or use the Website from other jurisdictions do so of their own volition and are responsible for compliance with local law. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, in certain jurisdictions, some of the above limitations of liability may not apply to you; all other provisions of this Agreement remain in full force and effect.

9. Indemnity

You agree to defend, indemnify and hold harmless The Happy Baby Class, its subsidiaries, affiliates, subcontractors, officers, directors, employees, consultants, representatives and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney’s fees and costs) arising from (i) your use of and access to the Website; (ii) your violation of any term of this Agreement; (iii) your violation of any third party right, including without limitation any copyright, property, or privacy right; or (iv) any claim that one of your submissions of content caused damage to a third party. This defence and indemnification obligation will survive this Agreement and your use of the Website.

10. Additional Terms

We may also require you to follow additional rules, guidelines or other conditions in order to participate in certain promotions or activities available through our Website, to obtain certain premium Content through our Website, or for other reasons. In addition, certain additional terms will govern any purchases you make through the online stores located on our various Websites. These additional terms will be posted on the relevant portions of our Website or on the portions of our Website that describe the specific promotions, Content, or activities. These additional terms are part of this Agreement, and you agree to comply with them when you participate in those promotions, purchase items from our online stores, or otherwise engage in activities governed by such additional terms.

11. Modification and Discontinuation

We reserve the right at any time to modify, edit, delete, suspend or discontinue, temporarily or permanently the Service or any of our Websites (or any portion thereof) with or without notice. You agree that we will not be liable to you or to any third party for any such modification, editing, deletion, suspension or discontinuance of the Service or our Website.

12. Assignment

This Agreement and any rights and licenses granted hereunder, may not be transferred or assigned by you but may be assigned by The Happy Baby Class without restriction.

13. Ability to Accept Terms of Service

You affirm that you are either more than 18 years of age, or an emancipated minor, or possess legal parental or guardian consent and are fully able and competent to enter into this Agreement, conditions, obligations, affirmations, representations, and warranties set forth in this Agreement, and to abide by and comply with this Agreement.
